This privacy policy describes how we collect, use, and disclose personal information when you visit and/or use our website, apps, or other products or services (collectively, our “Services”).

Information You Provide

The types of Personal Information that the Service collects directly from you may include:

In order to access certain content and to make use of additional functionality and features of the Service, we ask you to register for an account by completing and submitting a registration form, which may request additional information, which we use to customize Bot, M.D for you.

If you choose to register and sign in by using a third party account (such as your Facebook account), the authentication of your login is handled by the third party and the Service will collect your name, email address, and any other information about your third-party account that you agree to share with us at the time you give permission for your account on the Service to be linked to your third party account. 5 Health Inc. is a Data Controller (as defined in Data Protection Legislation) in respect to this ‘Personal Data’. The legal basis upon which we process Personal Data is our legitimate interest to provide Services to you.

Information Collected Automatically

The Service also automatically collects, through our servers and the use of cookies (small text files sent to your computer), web beacons (also known as clear or single pixel .gifs) and other technologies, information that tells us how you use the Service, such as:

  • Internet Protocol ("IP") address used to connect your computer to the Internet;
  • Computer, device, and connection information, such as browser type and version, operating system, mobile platform, and unique device identifier ("UDID") and other technical identifiers;
  • Uniform Resource Locator ("URL") click stream data, including date and time stamp, referring and exit URLs, search terms you used, and pages you visited or searched for on the Service;
  • and For location-aware services, the physical location of your device in order to provide you with more relevant content for where you are in the world.

We may collect non-personal information from your mobile device if you have downloaded our mobile application(s). This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include your geographic location, how you use the application(s), and information about the type of device you use. In addition, in the event our application(s) crash on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our application(s). This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.

When you use our Services, in addition to information described in our Policy, such as your profile and contact information, we may automatically collect certain information from your device including your precise geolocation, information about your device such as the device type, device ID, operating system, wireless service provider, and information about the operation of our application and your usage of our application, including features you used, pages you viewed, and when and for how long you used the application. By using the Bot M.D. Services, you agree that we may collect this information and use, transmit, process, and store that information as described in our Privacy Policy including to provide and improve our Services.

When you send or receive messages using our Services, we may process, analyze and store your messages (“Message Data”) in order to provide these Services to you. We use Message Data and analytics platforms only to improve the Services of Bot M.D. for you and other users on the platform.

We may use and disclose Anonymous Data that does not reveal your identity or permit direct association with any specific individual, such as browser and device information, anonymous usage data, and aggregated information, for any purpose, except where we are restricted by law. If we combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined.

You can control cookies through your browser's settings and other tools. However, if you block certain cookies, you may not be able to register, login to the Services, access certain parts of the Services or make full use of the Services.

If you have enabled location services on your phone, we collect your location information to make a map available to the recipients of your messages showing your location. If you do not want this information collected by us, you can disable location services on your phone.

C) USE OF YOUR INFORMATION
We may use your Personal Data to:

  • Provide the Service to you, such as allow access to or delivery of our products or services, process or fulfill an order or transaction, or administer surveys or promotional programs;
  • Respond to your requests, inquiries, comments, or concerns;

  • Offer you customized content and individualized personalization of the Service to make it more relevant to your interests and needs;

We may on occasion also match or combine the personal information that you provide with information that we obtain from other sources or that is already in our records, whether collected online or offline or by predecessor or affiliated group companies, for the purposes described above.

We often receive testimonials and comments from users who have had positive experiences with our Services. We occasionally publish such content. When we publish this content, we may identify our users by their first and last name and may also indicate their home city. We obtain the user’s consent prior to posting his or her name along with the testimonial. We may post user feedback on the website or application(s) from time to time. We will share your feedback with your first name and last initial only. If we choose to post your first and last name along with your feedback, we will obtain your consent prior to posting you name with your feedback. If you make any comments on a blog or forum associated with your website or application(s), you should be aware that any Personal Information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these blogs and forums.

D) DISCLOSURE OF YOUR INFORMATION
We may share your personal information with:

  • Relevant agents, representatives, joint ventures, and entities for which we are acting as an agent, licensee, or publisher, such as societies and sponsors;

We also may share your personal information with our affiliated group companies worldwide and with societies, sponsors, and other non-affiliated third parties that wish to send you information about their products and services that may be of interest to you as determined by your choices in managing your communications preferences following the process described below.

We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition or dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Information may also be transferred as a business asset. Some of our applications and Services may enable you to post content to SNSs (e.g., Facebook or Twitter). If you choose to do this, we will provide information to such SNSs in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of those websites and that it is your responsibility to review the terms of use and privacy policy of the third party provider of such SNSs. We will not be responsible or liable for: (i) the availability or accuracy of such SNSs; (ii) the content, products or services on or availability of such SNSs; or (iii) your use of any such SNSs.

If our Services offer a content database or learning service ("Subscription Service") and you access the Subscription Service through an institution-sponsored subscription, your personal information and certain usage data gathered through the Subscription Service, such as the number of items you downloaded, any non-subscribed items you accessed, and test scores, may be shared with your institution for the purposes of usage analysis, subscription management, course management and testing and remediation. If your institution is a corporation or other business entity, additional usage data, such as the types of records you viewed and the number of searches you ran, also may be shared for the purposes of cost attribution and departmental budgeting.

We also may need to disclose your personal information:

  • To respond to or comply with any law, regulation, subpoena, court order or other legal obligation;
  • To enforce and protect our rights and properties;
  • To detect, investigate and help prevent security threats, fraud or other malicious activity;

The Service may allow registered users to access their account information and make corrections or updates upon login at any time. The accuracy of such information is solely the responsibility of the user. You may also request access to other personal information about you that may be held in the Service. If you request to deactivate your account or delete your personal information, we will endeavor to fulfill your request but some personal information may persist in backup copies for a certain period of time and may be retained as necessary for legitimate business purposes or to comply with our legal obligations.

5 Health Inc. takes precautions designed to safeguard your personal information against loss, theft and misuse and unauthorized access, disclosure, alteration, and destruction through the use of appropriate administrative, physical and technical security measures.

Our website is scanned on a periodic basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. Your Personal Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information.

H) CROSS-BORDER TRANSFER OF YOUR INFORMATION

K) GOOGLE
Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.

L) COMPLIANCE WITH STATE AND FEDERAL LAWS

California Online Privacy Protection Act CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA we agree to the following:
Users can visit our site anonymously. Once this privacy policy is created, we will add a link to it on our home page or as a minimum on the first significant page after entering our website. Our Privacy Policy link includes the word 'Privacy' and can be easily be found on the page specified above. Users will be notified of any privacy policy changes when they login to their account.

How does our site handle “do not track” signals?
We honor “do not track” signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Does our site allow third-party behavioral tracking?
It’s also important to note that we allow third-party behavioral tracking to improve our users’ experience.

COPPA (Children Online Privacy Protection Act)When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under 13. If a child under 13 submits Personal Information to us and we learn that the Personal Information is the information of a child under 13, we will attempt to delete the information as soon as possible. CAN-SPAM Act The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to provide you with occasional calculator or service updates, which you can easily opt-out from.

If at any time you would like to unsubscribe from receiving future emails, you can email us at privacy@five.health and we will promptly remove you from ALL marketing correspondence. However, even if you unsubscribe from marketing emails, you may continue to receive administrative emails relating to your use of the Services.

We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures designed to help protect your Personal Information from unauthorized access, use, or disclosure. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we use reasonable efforts to protect your Personal Information, we cannot guarantee its absolute security.

This privacy policy may be updated from time to time for any reason. We will notify you of any changes to our privacy policy by posting the new policy on this website and within the application(s) and we will change the “Last Updated” date above.
